Pranab Mukherjee elected new Indian president


 

NEW DELHI: Former finance minister Pranab Mukherjee was elected Indian president on Sunday after votes from national and state lawmakers were counted in the race for the mainly ceremonial post.

Some analysts believe Mukherjee, a veteran from the ruling Congress party, may take a more active approach to the job than his predecessors as India struggles with a parliamentary deadlock and slowing economic growth. Mukherjee, 76, collected 69 percent votes, easily beating his only rival P A Sangma, 64, a former lower house speaker and tribal leader from the remote northeast who was backed by the main opposition Bharatiya Janata Party (BJP).

"I would like to thank the people of this great country for conferring this distinction by electing me to this high office," Mukherjee told crowds of cheering supporters gathered outside his residence in New Delhi.

India's president, who takes up residence in a 340-room palace built in the capital for the British viceroy during colonial rule, is chosen by legislators from the two houses of parliament and state assemblies.

The next general election, due to be held in 2014, is predicted to be close, which could lead to a period of complex horse-trading between numerous national and regional parties trying to form a stable coalition government.

"It's in this turbulent scenario Mukherjee as a president will be able to steer the ship of the state. He's a troubleshooter," said Sanjay Kumar, an analyst at India's Centre for the Study of Developing Societies.

Mukherjee may also try to use the presidential position to foster a behind-the-scenes deal between warring parties who have reduced parliament to a stalemate in recent sessions. He has a reputation as a canny negotiator, and was described by leaked US embassy cables in 2009 as "the ultimate Congress Party fixer and operator" with clear ambitions at that time to become prime minister.

Mukherjee commands widespread respect across party lines, but his performance as finance minister was criticised for his failure to push through reforms to further liberalise India's economy.

His exit from the ministry raised investors' hopes that Prime Minister Manmohan Singh, who took over the finance portfolio, could embark on long-awaited moves. Mukherjee's success on Sunday was a welcome victory for the embattled the Congress party, which has been beset by a string of graft scandals, policy reversals and a raft of disappointing economic data.

Sangma congratulated his opponent but criticised the Congress for running an "exceptionally partisan and political" campaign for the head of state. Mukherjee will be formally sworn in on Wednesday, taking over for a five-year term from Pratibha Patil, India's first woman president.

Rajesh Khanna: Bollywood first Superstar

From the dizzying heights of fame to quiet shadows behind the arclights, Rajesh Khanna's life had a theatrical sweep, almost like one of his films. Bollywood's original superstar - simply the phenomenon to some - died in Mumbai Wednesday, leaving behind memories cast in celluloid of that famous crooked smile and head tilt. He was only 69.

In an era long before this age of instant connect of mobile phones and internet, Rajesh Khanna was the man who sparked a frenzy never seen before and never since, not even by the likes of Amitabh Bachchan.

His very name spelt magic in the 1970s. He sparked hysteria, particularly amongst his legions of women fans, who would line the road for a glimpse, chant his name, cover his car with lipstick marks and even write him letters in blood. They got married to his photograph, cut their finger, let the blood flow and applied 'sindoor'.

Truly, "O mere di ke chain"!

Kaka, as he was popularly known, was one of the highest paid actors of his time, his record of consecutive solo super hits still unbroken. Who can forget the years between 1970-1979 when he starred in mega hits like "Safar", "Kati Patang", "Sachaa Jhutha", "Aan Milo Sajna", "Anand", "Amar Prem" and "Mere Jeevan Saathi". Ever the urbane, suave romantic who wooed like few others.

Glory and fame galore came his way with the two 1969 films - "Aradhana" and "Do Raaste" - where he teamed up with two of his best co-stars, Sharmila Tagore and Mumtaz, respectively. Both the films were super hits. Hindi film's first superstar was born.

Between "Aradhana" in 1969 and "Prem Kahani" in 1975, Rajesh enjoyed god-like status.

It was all about charisma - a certain something that went beyond the art of acting. He had that unique way of delivering a dialogue, of crinkling his eyes and that interesting head tilt that were all his own - and designed to get fans swooning.

Describing the charm of Rajesh Khanna, Amitabh once said: "I got famous purely because I was working with Rajesh Khanna in 'Anand'. People asked me questions like, 'How is he to look at? What does he do?'"

The mega story had a small beginning in Amritsar. Born Jatin Arora on Dec 29, 1942, he was adopted and raised by foster parents.

He went from being Jatin to Rajesh, thanks to his uncle who changed his name, when he decided to join films.

In 1965, the journey to filmdom started after he won the All India Talent Contest organised by United Producers and Filmfare. He made his debut with "Aakhri Khat" in 1966.

It was a fairly easy road to superstardom after that.

He became the heartthrob of the nation, singing timeless melodies like "Mere Sapnon Ki Rani..." in "Aradhana", "Zindagi Ek Safar" in "Andaaz" or "Yeh Shaam Mastani" in "Kati Patang". Singer Kishore Kumar and composer R.D. Burman were amongst his closest friends.

In his four-decade career, he appeared in about 160 films, of which 106 had him as the solo lead hero and 22 were two hero projects.

Rajesh proved his mettle in offbeat films too. He teamed up with Hrishikesh Mukherjee for the critically acclaimed "Bawarchi" and "Namak Haram". The quintessential romantic also did the intense "Avishkar", directed by Basu Bhattacharya.

But then age caught up and the star began fading away.

He moved to television and played the main lead in two serials - "Ittefaque" and "Apne Paraye" during 2001-02 and also featured in "Raghukul Reet Sada Chali Aayi" between 2008-09.

The decline to B-grade films was inevitable. There was also the sorry "Wafa" with Laila Khan, who was found murdered this July.

He dabbled in politics, being Congress MP from the New Delhi constituency from 1991-1996.

Like the Hollywood legends of yore, the personal life also had a larger than life dimension.

He fell in love with Dimple Kapadia, who was only 16 and whose first film "Bobby" was yet to release. She was 15 years younger to him but the pull was strong and they got married after a whwhirwind romance in 1973.

It was the stuff of tabloid headlines. They had two daughters Twinkle and Rinke. The marriage lasted only 11 years.

It was a lonely life for Rajesh after that. He disappeared from the headlines and appeared to be a shadow of his former self in his rare public appearances.

But the family came together in his last days. His estranged wife was the one who took care of him during his illness. Son-in-law Akshay Kumar was also a great comfort.

Rajesh reappeared in an ad a few months before his death, and once again became the talk of town - he was clearly unwell but the zest in his voice was intact as he intoned "Babumoshai" from his much loved film "Anand".

Like Anand from the film, the man is gone. But the memories will live on.

Here are some facts about Rajesh Khanna's films which most of the articles fail to notify, especially his critically acclaimed superhits and award worthy performances but commercially unsuccessful movies of the period 1976-1991. Aaina, Maalik and Raja Rani were good films which unfortunately flopped.
Aaina was remade by Balachander of his award winning Tamil hit. Plus Mahachor and Shehzada were huge hits at the box office. Shehzada elevated Surinder Kapoor's production house to A grade level(Anil Kapoor's father).Khanna had 35 Golden Jubilee hits in 1967-1975 period and 35 more Golden Jubilee hits in 1979-1991 period. In 1976-78, he had 7 critically acclaimed films which flopped at the box office(especially Tyaag, Mehbooba, Chakaravyuha, Naukri, Palkon Ki Chhaon Mein  though flopped have excellent performances by Khanna and were unfortunate flops.
Even directors of these films accepted this fact) and had 2 more flops which was panned by critics in 76-78 and the 4 commercial hits of 76-78 were Chhaila Babu, Anurodh,Mahachor and Karm. To say that after Namak Haram, Khanna's career went downhill is rubbish, as Aap Ki Kasam, Roti, Prem Kahani, Prem Nagar all came only after Namak Haram.
In 1979, he had Punjabi hit film Til Til Dalekha and Amardeep in Hindi as hits, with which he bounced back. Media does not highlight the solo hit movies of Khanna of 80's properly - Aanchal, Phir Wohi Raat, Bandish , Kudrat,  Dard ,Dhanwan, Prem Bandhan,Fiffty Fiffty,Ashanti,Souten,Avatar,Agar Tum Na Hote,Awaaz, Angaarey,Naya Kadam, Hum Dono,Akhir Kyun, Babu, Bewafai,Adhikar, Shatru, Anokha Rishta, Nasihat, Amrit, Awaam etc..and multi star hits like Rajput, Maqsad , Zamana, Dharm Aur Qanoon  etc....he had 22 silver jubliee hits in 1966-1991 period and 73 Golden jubliee hits in 1966-1991(3 golden jubliee hits in 76-78 period).
Khanna remained a favorite with producers throughout his career. Films like Redrose and Aaj Ka MLA Ram Avtar though flopped were critically acclaimed and Khanna has performed well even in them. Infact every producer has repeated Khanna in their films atleast 3 times...in his career, at different times with author backed role for Khanna eg- BR Chopra had 3 hits with Khanna (Ittefaq -1969, Karm in 1977, Awam in 1987) same goes the case with D Rama Naidu, Shakti Samanta, Yash Chopra, Narinder Bedi, K. Raghavendra Rao, Narayana Rao Dasari, J.Om Prakash, Mohan Kumar etc...So story of big producers shying away from approaching Khanna is a fiction and Khanna has minimum of 4 films releasing every year from 1970-1991.
Another highlight of Khanna's career was" his record in 1985 - 8 superhits off the 11 released as the lead hero" and in year 1985 he also made special appearance in Aar Par(a flop) and had unreleased film Bayen Hath Ka Khel, which had its musical release in 1985. Also his 15 consecutive solo superhits was in period 1969-1971 - and the name of 15 films are Aradhana, Doli, Bandhan,Ittefaq ,Do Raaste , Khamoshi, Safar,The Train ,Kati Patang,Sachaa Jhutha ,Aan Milo Sajna , Mehboob Ki Mehendi,Dushmun ,Anand ,Haathi Mere Saathi.

Bollywood actor Rajesh Khanna dies at 69


Mumbai - According to a TV news channel superstar Rajesh Khanna is no more after being critical ill from last few months. Latest reports suggest that all his family members have gathered at his Bandra house and the house has been cordoned off by police officials. The funeral time is 4.30 pm in Mumbai today.

Khanna had been suffering from bad health since some time and buzz had it that the actor's liver had been damaged due to his alcohol addiction.

He breathed his last in the presence of his wife Dimple Kapadia, daughters Rinkie and Twinkle, son-in-law Akshay Kumar, grand children and close relatives.

Iconic wrestler-turned-actor Dara Singh passes away

MUMBAI 12 July, 2012: Legendary wrestler and actor Dara Singh passed away at his Mumbai home early on Thursday. He was 83.

Dara Singh, who was admitted to Kokilaben Hospital last week after a cardiac arrest, was taken back to his home on Wednesday night after his condition failed to improve despite continuous medical effort. Doctors, on Wednesday, had said that chances of Dara Singh's recovery were poor.

Doctors said that Dara Singh had suffered significant brain damage after the cardiac arrest.
He had appeared in films like "Watan Se Door", "Daada", "Rustom-E-Baghdad", "Sher Dil", "Sikandar E Azam", "Raaka", "Mera Naam Joker" and "Dharam Karam". He was last seen in the 2007 release "Jab We Met".

World champion wrestler Dara Singh, who joined the film industry in 1960s, was last seen in 2007 movie 'Jab We Met' alongside Kareena Kapoor and Shahid Kapoor.

‘Mahabali’ Dara Singh was the undisputed champion of champions in the wrestling ring and has won many times including the world championship in 1968.

He took to acting in 1962 and is best remembered for his portrayal of Hanuman in popular TV series ‘Ramayan’.

Dara Singh, who was a Rajya Sabha member from August 2003 to 2009, was best remembered for his iconic role as 'Hanuman' in the epic TV serial 'Ramayan'.

He had also directed films.

Dara Singh was also known for his generous kind nature. Affable to the extreme, he made friends easily and never misused his power even in his heydays.

He was a gentleman. India has a lost a jewel today. All Canadain NRIs plunged into deep soorow.

We miss him a lot. May God rest the soul in peace.

Avtar Henry is British citizen, Union Home Secretary informs HC lawyer


 
Case of Arvind Khanna's British citizenship adjourned to July 12
CHANDIGARH: The Union Home Ministry has confirned that Avtrar Henry former Congress minister and four time MLAS from Jalandhar is a foreign national and he has obtained the citizenship of United Kingdom.
Arora said that real name of Avtar Henry is Avtar Singh Sanghera and his father name in Indian records is Lakhbir Singh. However in his british passport, the name of his father is mentioned as Joginder Singh.
This was stated by H.C.Arora lawyer pf petitioner Ajay Sehgal who filed petition in the Punjab and Haryana High Court challenging Indian citizenship of Henry. Arora said that he was informed about the status of Henry's citizenship by Secretary in Union Home Ministry.
Arora in his petition has told the court that Henry who was four time MLA and remained cabinet minister in Punjab government was not an Indian citizen. He informed the court that Henry had voluntarily obtained british citizenship in January 1968. Hew got british passport on May 1, 1968 and he also travelled on this passport to India.

The High Court had directed the Union Home Ministry and Foreign affairs minsitry to give report on status of citizenship of Avtar Henry.
Meanwhile, Punjab and Haryana High Court has adjourned till July 12 another similar petition filed against Dhuri MLA Arvind Khanna. His election has been challenged in the High Court by Gobind Singh Kanjhla defeated candidate of SAD. Kanjhla has claimed in the petition that Arvind Khanna is not an Indian Citizen and he holds British passport. He has demanded to cancel the election and order repoll in Dhuri.
Lakhwinder Singh Sidhu lawyer of petitioner said that judge Gurmit Singh Sandhawalia has adjourned the hearing to July 12.

दोहरी नागरिकता मामले में हेनरी दिल्ली तलब

जालंधर. सीनियर कांग्रेसी व राज्य के पूर्व कैबिनेट मंत्री अवतार सिंह हैनरी उर्फ अवतार सिंह संघेड़ा को दोहरी नागरिकता के मामले में गृह विभाग ने दिल्ली तलब किया है। हैनरी को 10 जुलाई को नई दिल्ली की जय सिंह रोड स्थित एनडीसीसी -2 बिल्डिंग स्थित डायरेक्टर (आईएंडसी) मिनिस्ट्री ऑफ होम अफेयर्स के दफ्तर में कमरा नंबर ए-107 में सुबह 11 बजे पेश होने को कहा गया है।

दिल्ली में उनसे दोहरी नागरिकता को लेकर सवाल-जबाव किए जाएंगे। गौर हो कि हैनरी के दो अवतारों की जांच क्राइम ब्रांच कर रही है। हैनरी की पहली पत्नी सुरिंदर कौर के बेटे गुरजीत सिंह संघेड़ा ने आरोप लगाया था कि उनके पिता की दोहरी नागरिकता है। गुरजीत सिंह ने आरोप लगाया था कि उनके पिता ब्रिटिश नागरिक हैं। हैनरी पर यह भी आरोप है कि उन्होंने बिना तलाक दिए दूसरी शादी की है। इस मामले की जांच क्राइम ब्रांच कर रही है।

New Delhi - Veteran journalist Kuldip Nayar is no stranger to controvers and once again he has stirred a hornet's nest. The veteran journalist and author Kuldip Nayar has courted a fresh controversy by alleging that Sikh Student’s Federation president Bhai Amrik Singh, who died during Operation Blue Star in June 1984, was “IB agent”. Stirring a hornets’ nest, Nayar has written that it was an open secret that Amrik Singh, president of Sikh Students Union (read Federation) was IB’s agent. In his latest book "Beyond the Lines: An Autography", the veteran journalist claims that former President Giani Zail Singh 'blessed the Sikh radical organisation Dal Khalsa to take on the Akalis'. These claims have been rubbished by Dal Khalsa as completely baseles, but Kuldip Nayar stands by his revelation claiming he was told by none other than the former President of India himself. 


In his recently published autobiography Kuldip Nayar has also alluded to the role of Dal Khalsa while writing about the genesis of the Punjab problem. Nayar in his 16 page Punjab chapter titled “Punjab in flames”, has alleged that Jarnail Singh Bhindranwale was creation of the then Congress.

The Sikh radical group Dal Khalsa is up in arms against the Nayar, calling his allegations as senseless and baseless. Party head H S Dhami interacting with the media said the great Sikh personalities and the Dal Khalsa continue to bear the burden of the sophisticated malign
campaign of the Indian authors and writers. 


Notably, Nayar has claimed that the formation of Dal Khalsa was engineered by Gaini Zail Singh to “needle the Akalis”.  “As far as Dal Khalsa is concerned there was no iota of truth in Nayar’s accusation”.


He said the avowed agenda of the Dal Khalsa was to confront and curtail the anti-Sikh policies of the state. The organization defied the mainstream political parties including the Akalis. Therefore, by virtue of its nature, its formation simultaneously created two
adversaries- the Indian state and the traditional Akalis.

Interestingly, Tarlochan Singh, the former Personal Assistant to Gaini Zail Singh has refuted Kuldip Nayar’s contention saying that his mentor was not behind the creation of radical Sikh outfit.

“Nayar has not only passed derogatory remarks against Sikh leadership of that time but had also attempted to do character assassination of Sant Jarnail Singh Bhindrawale and Bhai Amrik Singh, said he and added that no sensible person can believe in Nayar’s senseless accusations”.
Sounding a warning, he said how long the Sikhs would tolerate the insult to their martyrs.

In his book, Nayar has quoted an MP Kamal Nath who claimed that they provided “money to Santji off and on to challenge the Akali government”.

Kamal Nath is alive and minister in UPA government. He must speak out when he interviewed Santji as written by Nayar, and who others were present during that time and the amount he gave to Santji , he asked. Dhami challenged Nath to provide a single concrete evidence to prove his baseless allegation.

Govt buys Gandhi’s archive for $1.28 million


Contains documents of his controversial relatioship with architect Hermann Kallenbach

Mahatma Gandhi’s prized documents and photographs, including those on his controversial relationship with architect Hermann Kallenbach, were saved from going under the hammer as India bought the treasure trove for a whopping $1.28 million.
The archive, which belonged to Kallenbach, Gandhi’s close friend and German Jewish bodybuilder, was to be auctioned at Sotheby’s today but it was cancelled after the back-channel talks by the Indian Government with the auction house and the family members of Kallenbach helped India take possession of the rare documents.
The documents will now be housed at the National Archives of India in New Delhi.
An agreement was finalised in consultation with Ministry of External Affairs and National Archives of India and was signed by the three parties — Government of India, Sotheby’s and the family of Isa Sarid, the grandniece of Kallenbach.
“The acquired material would be housed in the National Archives of India,” Culture Minister Kumari Selja said in a statement in New Delhi.
 Though the Sarid family, which owns the treasure trove, quoted $5 million as price for the archives, finally an amount of $1.28 million was paid.
“The payment of £8,25,250 ($1.28 million) has been released to Sotheby’s and the lot has been withdrawn from auction and sold to the Government of India,” the statement said.
 The archive, which is likely to be a rich source of information on Gandhiji for researchers and historians, was recently examined by a team of experts from the Ministry of Culture, who described it as “very well preserved and of inestimable value.”
 The archive includes several letters that throw fresh light on the controversial relationship between Gandhiji and Kallenbach, one of the foremost associates and friends of Gandhiji during his time in South Africa.
The auctioneer’s Catalogue Note on the archive said that it “is richly informative of the important (and occasionally misunderstood) friendship between the two men, and is a key biographical source for Gandhi.”
The archive includes “poignant letters” by the deeply troubled Harilal, Gandhi’s first son, and reveals Kallenbach’s deep friendship in particular with Gandhi’s second son Manilal, who remained on Phoenix Settlement in South Africa, and his third son Ramdas.
In the statement in New Delhi, Ms. Selja said the Government of India attaches the highest importance to the archival materials and artefacts relating to the leaders of national movement.
A five member Committee led by Prof Mushirul Hasan, Director General, National Archives, was earlier deputed to London to examine the archival material for authenticity and historical value.
The Committee had recommended that in view of the historical importance of the material, the entire archive may be acquired as a matter of highest priority.
In London, Sotheby’s said the deal was concluded in a “private transaction.” However, it did not disclose the amount the Indian government paid for the documents.

No service tax to be levied on NRI remittances: Finance Ministry

New Delhi, July 10
The Finance Ministry today clarified that no service tax would be levied on NRI remittances from overseas.
The clarification by the Central Board of Excise and Customs (CBEC), which functions under the Finance Ministry, follows concerns over reports that there was a move to levy 12 per cent tax on money sent back home by Indians abroad under the changed service tax regime from July 1.
The CBEC said in a circular “that the matter has been examined and it is clarified that there is no service tax per se on the amount of foreign currency remitted to India from overseas”. In the negative list regime, “service” excludes transaction in money. As the amount of remittance comprises money, the activity does not comprise a “service” and is not subjected to service tax, the circular clarifies.
It further added that “in case any fee or conversion charges are levied for sending such money, they are also not liable to service tax as the person sending the money and the company conducting the remittance are located outside India. Such services are deemed to be provided outside India and thus not liable to service tax”.
It has been further clarified that even the Indian counterpart bank or financial institution which charges the foreign bank for the services provided at the receiving end, is not liable to service tax as the place of provision of such service is outside India.
The clarification will alleviate concerns of NRIs as India is one of the top recipient of remittances ($64 billion in 2011), according to the World Bank data. Given the dire need for dollar at a time when current account deficit is high and Rupee is under pressure, any move to levy service tax on NRI remittances would have been disastrous.
CMs of Punjab and Kerala, which are among the states receiving the largest remittances from NRIs, had taken up the matter with Prime Minister Manmohan Singh.
M Rafeeque Ahmed, president, Federation of Indian Export Organisations (FIEO), said that towards addressing the trade deficit, remittances were the single largest source of unconditional flow of foreign exchange into India, according to estimates by the World Bank. Given the slowdown and declining levels of foreign exchange, service tax could only act as a deterrent to precious incoming foreign exchange, he added.
He said the waiver of service tax on the same would ensure that this stable source of foreign exchange would continue to maintain the delicate balance of payments position of India at this moment of global crisis.

False Alarm! Air India flight makes emergency landing in Pakistan, passengers safe


Relief aircraft brings back 128 passengers, crew safely to Delhi

New Delhi/Nawabshah Airport, July 9
It’s a journey, which will be etched in their memories forever. As many as 128 passengers and crew of Air India’s Abu Dhabi-Delhi flight, which had to make an emergency landing in Pakistan after a technical snag, are back home safe. They were flown back in a special relief plane which took from Nawabshah airport in Pakistan and landed at the Indira Gandhi International Airport here at 5 pm. An hour later, the “snag-hit” airbus also returned to Delhi.

Flight AI-940, which departed from Abu Dhabi at 0015 hours on Monday after originating from Bahrain, had to land at Nawabshah airport in the Sindh province after pilots noticed a hydraulic failure warning.
"The aircraft was flying over Pakistani air space when a pilot saw a warning light in the cockpit and sought permission to land at the nearest airport which was Nawabshah," said an Air India spokesperson.
Pakistan High Commission spokesman Manzoor Ali Memon said Pakistan allowed the Indian aircraft to land at Nawabshah airport. “Passengers were given visas on arrival at the airport. 
They were extended hospitality and support by the Pakistan Government,” he said. MEA Special Secretary Ashok Tomar, who received the passengers in Delhi, praised the Pakistani authorities for their help. “We are happy this situation has ended now and passengers are back. They were treated well by the Pakistan authorities.”
Pakistan's Civil Aviation Authority spokesman Pervez George said the stranded passengers were offered lounge facilities but the pilot declined and did not allow the passengers to come out of the plane, apparently over security concerns.
As per preliminary reports of the engineers flown to Pakistan to check the stranded aircraft, the instrument panel emitted a “false alarm” (pertaining to hydraulic failure) on the computer system.”The cockpit panel emitted false alarm, causing red lights on the control panel to blip. There was nothing wrong with the hydraulics system,” said engineers.
The Civil Aviation Ministry has forwarded an incident report to the PMO. This may be followed by a detailed analysis of by the airline’s permanent investigation board. Since the incident was an “uncommon” occurrence, sources said the civil aviation regulator, DGCA, may even constitute a probe committee.
Backing pilots, experts said they made a right decision. “All warnings lights on the instrument control panel have to be taken seriously. Even the smallest technical glitch in the computer system needs to be rectified before the aircraft takes off again. For each warning light on the instrument panel, there are specified actions in the flight manual-to continue to destination, divert to the most appropriate airfield or land as soon as possible,” said experts.

SC: panchayats enjoy Constitutional status



NEW DELHI: Panchayats can formulate their own programmes of economic development and social justice as they enjoy a Constitutional status, the Supreme Court has ruled.
The apex court said Article 40 and Articles 243 to 243-O envisages that the framers of the Constitution had envisaged village panchayat to be the foundation of the country's political democracy - a decentralised form of government where each village was to be responsible for its own affairs.
Bench of Justices G S Singhvi and S J Mukhopadhya passed the ruling while allowing an appeal filed by the village panchayat of Calangute in Goa challenging a Bombay High Court order which had taken the view that the local body cannot challenge any decision taken by the executive authority.
In this case, the Additional Director of Panchayat-II had overruled a resolution passed by the panchayat quashing the permission granted to a private company for carrying out certain commercial activities.
Though the panchayat appealed against the official's decision the high court dismissed it following which it appealed in the apex court.
"The primary focus of the subjects enumerated in the Eleventh Schedule is on social and economic development of the rural parts of the country by conferring upon the Panchayat the status of a constitutional body.
"Parliament has ensured that the Panchayats would no longer perform the role of simply executing the programmes and policies evolved by the political executive of the state. 
"By virtue of the provisions contained in Part IX, the panchayats have been empowered to formulate and implement their own programs of economic development and social justice in tune with their status as the third tier of Government which is mandated to represent the interests of the people living within its jurisdiction", the Bench said. 
The apex court said the Constitution's Preamble, Part IV and Part IX must guide our understanding of the Panchayati Raj institutions and the role they play in the lives of the people in rural parts of the country.
"The conceptualisation of the village panchayat as a unit of self government having the responsibility to promote social justice and economic development and as a representative of the people within its jurisdiction must be borne in mind while interpreting the laws enacted by the state which seek to define the ambit and scope of the powers and the functions of Panchayats at various levels.
"An analysis of Article 40 and Articles 243 to 243-O shows that the framers of the Constitution had envisaged village panchayat to be the foundation of the country's political democracy - a decentralised form of government where each village was to be responsible for its own affairs," the Bench said.
According to the court by enacting the Constitution (Seventy-third Amendment) Act, Parliament has attempted to remedy the defects and remove the deficiencies of the Panchayati Raj system evolved after independence, which failed to live up to the expectation of the people in rural India.
"The provisions contained in Part IX provide firm basis for self-governance by the people at the grass root through the institution of panchayats at different levels.
"For achieving the objectives enshrined in Part IX of the Constitution, the state legislatures have enacted laws and made provision for devolution of powers upon and assigned various functions listed in the Eleventh Schedule to the Panchayats", the court said.
Hence it directed the High Court to issue notices on the issue raised by the panchayat and decide the matter on merits. PTI

ਟੋਰਾਂਟੋ, 2 ਜੁਲਾਈ - ਆਪਣੀ ਯੋਗਤਾ ਦੇ ਆਧਾਰ 'ਤੇ ਕੈਨੇਡਾ ਦੀ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਅਪਲਾਈ ਕਰਕੇ ਵੀਜੇ ਦੀ ਉਡੀਕ ਕਰ ਰਹੇ ਉਨ੍ਹਾਂ ਲੋਕਾਂ ਲਈ ਇਹ ਖ਼ਬਰ ਉਦਾਸ ਕਰਨ ਵਾਲੀ ਹੈ ਕਿ ਕੈਨੇਡਾ ਦੇ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਮੰਤਰਾਲੇ ਵੱਲੋਂ ਜਾਰੀ ਕੀਤੀਆਂ ਗਈਆ ਤਾਜ਼ਾ ਹਦਾਇਤਾਂ ਅਨੁਸਾਰ ਸਕਿੱਲਡ ਵਰਕਰਜ਼ ਕੈਟੇਗਰੀ ਹੇਠ 27 ਫਰਵਰੀ 2008 ਤੋਂ ਪਹਿਲਾਂ ਅਪਲਾਈ ਕੀਤੇ ਹੋਏ ਕੇਸ ਫੀਸ ਸਮੇਤ ਵਾਪਿਸ ਕਰਨ ਦਾ ਕੰਮ ਸ਼ੁਰੂ ਹੋ ਗਿਆ ਹੈ। ਵਿਭਾਗ ਵੱਲੋਂ 29 ਜੂਨ 2012 ਨੂੰ ਅਪ੍ਰੇਸ਼ਨਲ ਬੁਲੇਟਿਨ 442 ਜਾਰੀ ਕੀਤਾ ਗਿਆ ਹੈ ਜਿਸ ਵਿਚ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਅਧਿਕਾਰੀਆਂ ਨੂੰ 29 ਜੂਨ ਤੋਂ ਹੀ ਉਪਰੋਕਤ ਕੇਸਾਂ ਦੀਆਂ ਫਾਇਲਾਂ ਬੰਦ ਕਰਕੇ ਅਰਜ਼ੀਕਰਤਾਵਾਂ ਨੂੰ ਫੀਸ ਰਿਫੰਡ ਕਰਨ ਦੀ ਹਦਾਇਤ ਦਿੱਤੀ ਗਈ ਹੈ। ਬੁਲੇਟਿਨ ਅਨੁਸਾਰ ਜਿਨ੍ਹਾਂ ਕੇਸਾਂ ਬਾਰੇ ਕੈਨੇਡਾ ਦੇ ਵੀਜ਼ਾ ਅਫਸਰਾਂ ਵੱਲੋਂ 29 ਮਾਰਚ 2012 ਤੋਂ ਪਹਿਲਾਂ ਅਰਜ਼ੀਕਰਤਾਵਾਂ ਦੇ ਸਕਿੱਲਡ ਵਰਕਰ ਵਜੋਂ ਯੋਗ ਹੋਣ ਬਾਰੇ ਨਿਰਣਾ ਨਹੀਂ ਲਿਆ ਗਿਆ ਉਹ ਸਾਰੇ ਕੇਸ ਬੰਦ ਕਰ ਦਿੱਤੇ ਜਾਣੇ ਹਨ। ਜਿਨ੍ਹਾਂ ਲੋਕਾਂ ਦੀ ਯੋਗਤਾ 29 ਮਾਰਚ 2012 ਤੋਂ ਪਹਿਲਾਂ ਨਿਰਧਾਰਤ ਹੋ ਚੁੱਕੀ ਸੀ ਉਨ੍ਹਾਂ ਦੇ ਕੇਸ ਵਾਪਿਸ ਨਹੀਂ ਕੀਤੇ ਜਾਣਗੇ ਅਤੇ ਆਖਰੀ ਫੈਸਲਾ ਹੋਣ ਤੱਕ ਕੇਸ ਚਲਦਾ ਰਹੇਗਾ ਪਰ ਜਿਨ੍ਹਾਂ ਕੇਸਾਂ ਦੀ ਯੋਗਤਾ 29 ਮਾਰਚ 2012 ਤੋਂ ਬਾਅਦ ਨਿਰਧਾਰਤ ਕੀਤੀ ਗਈ ਪਰ 29 ਜੂਨ 2012 ਤੋਂ ਪਹਿਲਾਂ ਆਖਰੀ ਫੈਸਲਾ ਨਹੀਂ ਲਿਆ ਜਾ ਸਕਿਆ ਉਹ ਸਾਰੇ ਕੇਸ ਵੀ ਬੰਦ ਕਰਕੇ ਫੀਸਾਂ ਮੋੜ ਦਿੱਤੀਆਂ ਜਾਣਗੀਆਂ। ਫੀਸ ਵਾਪਿਸ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਦੂਤ ਘਰ ਵੱਲੋਂ ਅਰਜ਼ੀਕਰਤਾਵਾਂ ਨੂੰ ਇਸ ਬਾਰੇ ਚਿੱਠੀਆਂ ਰਾਹੀਂ ਸੂਚਿਤ ਕੀਤਾ ਜਾਵੇਗਾ। ਚਿੱਠੀ ਦਾ ਜਵਾਬ ਭਾਵ ਪਤੇ ਆਦਿਕ ਦੀ ਦਰੁਸਤੀ ਮਿਲਣ ਤੋਂ ਬਾਅਦ ਦੂਤ ਘਰ ਵਲੋਂ ਫੀਸ ਮੋੜੀ ਜਾਵੇਗੀ। ਦਿਲਚਸਪ ਗੱਲ ਇਹ ਹੈ ਕਿ ਇਸ ਮਾਮਲੇ ਵਿਚ ਕੈਨੇਡਾ ਦੇ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਮੰਤਰਾਲੇ ਵਿਰੁੱਧ ਹਜ਼ਾਰਾਂ ਪੰਜਾਬੀਆਂ ਸਮੇਤ ਸੰਸਾਰ ਭਰ ਦੇ ਤਕਰੀਬਨ ਪੌਣੇ ਤਿੰਨ ਲੱਖ (ਨਿਰਾਸ਼) ਅਰਜੀਕਰਤਾਵਾਂ ਨੇ ਆਪੋ-ਆਪਣੇ ਵਸੀਲੇ ਨਾਲ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਐਂਡ ਰਫਿਊਜ਼ੀ ਪ੍ਰੋਟੈਕਸ਼ਨ ਐਕਟ ਦੀ ਧਾਰਾ 87.4 ਤਹਿਤ ਕਾਨੂੰਨੀ ਚਾਰਾਜੋਈ ਕੀਤੀ ਹੈ। ਇਸ ਕਰਕੇ ਵਾਪਸ ਕੀਤੇ ਜਾ ਰਹੇ ਕੇਸਾਂ ਦੀਆਂ ਫਾਈਲਾਂ ਅਤੇ ਦਸਤਾਵੇਜ਼ ਕੈਨੇਡਾ ਦਾ ਇੰਮੀਗ੍ਰੇਸ਼ਨ ਵਿਭਾਗ ਘੱਟ ਤੋਂ ਘੱਟ ਅਗਲੇ ਦੋ ਸਾਲ ਸੰਭਾਲ ਕੇ ਰੱਖੇਗਾ ਤਾਂ ਜੋ ਅਦਾਲਤ ਦੇ ਫੈਸਲੇ ਅਨੁਸਾਰ ਕੇਸ ਮੁੜ ਖੋਲ੍ਹਣ ਵਿਚ ਰੁਕਾਵਟ ਨਾ ਪਵੇ।
